Jury deciding sentence in Texas sex assault case

A jury has sentenced a man convicted of taking part in the repeated sexual assault of a middle school student to 99 years in prison.

Eric McGowen wasn't in court Thursday. He was free on bail when he skipped out during a break in Wednesday's proceedings and is a fugitive.

The jury earlier Thursday found the 20-year-old McGowen guilty of aggravated sexual assault of a child. McGowen's lawyer didn't present any evidence or call any witnesses.

McGowen faced a minimum sentence of 25 years prison and a maximum of life.

Prosecutors say he was among 20 men and boys who took part in sexually assaulting the girl on at least five occasions in late 2010, when she was 11.

Six juveniles and two adults have pleaded guilty.

First impressions: Sony's James Bond smartphone

Sony unveiled its new range of smartphones including the mobile that will be used by James Bond in his new film Skyfall.

The Xperia T smartphone is the latest high end Android smartphone to be released by Sony since its buyout of Sony-Ericsson, and while feature heavy, still doesn't appear to leap ahead of the raw power of some of its competitors.

It will be running a 1.5GHz dual core Qualcomm Snapdragon processor, with 1GB or RAM, surprising for a top shelf device as most of Sony's competitors are moving to quad core processors. The Samsung Galaxy S3, which released in April, and is now the top selling Android phone, has a 1.4GHz quad core Exynos processor. The iPhone 5 is expected to launch with a dual core minimum, and possibly a quad core GPU.

It will also feature a 4.6-inch screen running at 1280x720, with a 13MP camera. Surprisingly it isn't 4G compatible, unusual since 4G networks (excluding the UK) and their operators are moving out of the nascent phase and looking for high end devices to sell the service.

The Xperia T will also be featured prominently in the new James Bond film, Skyfall - but again, this has historically not translated into big sales boosts for the company. Sony is also continuing to push the Walkman brand, which integrates its music and movie store with the device.

It will launch with NFC capabilities for mobile payments (and connecting to other Sony devices) and will run Google Android 4.0 (Ice Cream Sandwich) with an update to 4.1 promised (Jellybean). Sony is also pushing MHL connectivity to TVs, but will provide HDMI options for those of us older TVs.

Sony has also finally done away with its ridiculous proprietary memory card format, Memory Stick, and the device will now use MicroSD only.

Sony's efforts to vertically and horizontally integrate its mobile, gaming and photography platforms under one roof may still be under construction, but it has confirmed that the entire Xperia range will be Playstation Mobile compatible.

What does this mean? PlayStation Mobile was announced earlier in the year as a software framework that will be used to provide downloadable Playstation games and software for devices that meet the company's requirements. For example, this would mean that consumers owning a Sony TV, Xperia Phone, tablet or a Playstation video game console could all play the same version of an app or game. Sony has been struggling to attract independent developers so far (its Playstation Vita console has also failed in the face of smartphones and tablets), and most users would be tempted to stick to the Google Play (Android) app store.

Sony's Xperia V is a similarly powered device to the T with a smaller screen size. Its key differentiating factors is its 4G LTE support and minor water proofing to 1m for 30 minutes. The Xperia J, is a stripped down budget version of the range missing many of the aforementioned features. All three products will be brought to the market over the next few months, but no prices were specified.

Isaac brings higher gas prices, south and north

NEW YORK (AP) ? Drivers are being hit with the biggest one-day jump in gasoline prices in 18 months just as the last heavy driving weekend of the summer approaches.

As Hurricane Isaac swamps the nation's oil and gas hub along the Gulf Coast, it's delivering sharply higher pump prices to storm-battered residents of Louisiana and Mississippi ? and also to unsuspecting drivers up north in Illinois, Indiana and Ohio.

The national average price of a gallon of gas jumped almost five cents Wednesday to $3.80, the highest ever for this date. Prices are expected to continue to climb through Labor Day weekend, the end of the summer driving season.

"The national average will keep ticking higher, and it's going to be noticeable," says Patrick DeHaan, senior petroleum analyst at Gasbuddy.com

The wide storm shut down several refineries along the Gulf Coast and others are operating at reduced rates. In all, about 1.3 million barrels per day of refining capacity is affected. So, it's no surprise that drivers in Louisiana, Alabama, Mississippi and Florida saw gas prices rise by a dime or more in the past week.

But some states in the Midwest are suffering even more dramatic spikes. Ohio prices jumped 14 cents, Indiana prices soared 13 cents and Illinois prices jumped 10 cents on Wednesday alone according to the Oil Price Information Service. Days before Isaac is expected to douse those states with rain, the storm forced the shutdown of a pipeline that serves a number of Midwest refineries.

Drivers in the region were angry and confused. "''I saw gas in my neighborhood for $3.56 a gallon just Tuesday morning, and now I'm paying $3.95. It's terrible," said Mary Allen of Cincinnati as she paid $20 for just over five gallons of gas. She wondered how Isaac could drive up gas prices in Ohio ? and then resigned herself to a holiday weekend without travel.

The price surge is happening at the wrong time and the wrong place for Dickson Stewart, a 56-year-old electronics consultant, who is driving from Minneapolis to Savannah, Ga. this week. He stopped at a BP station in downtown Chicago Tuesday ? home to some of the highest retail prices in the country ? and paid $4.49 a gallon to fill up his Jeep Wrangler.

Stewart expects gas prices to fall after Labor Day. Analysts say he's probably right.

As Isaac fades away, the summer driving season ends, and refiners switch to cheaper winter blends of gasoline, stations owners should start dropping prices. "There is some very good relief in sight," DeHaan says.

When Katrina hit in 2005, the national average for gas spiked 40 cents in six days and topped $3 per gallon for the first time. Isaac likely won't have the same result, though its full impact on the refineries is yet to be determined.

The refineries are not expected to suffer long term damage. But refiners decided to shut down or run at reduced rates to protect their operations.

These facilities consume enormous amounts of electric power and generate steam to cook crude oil into gasoline, diesel, jet fuel and heating oil. If a refinery loses power suddenly, operators can't properly clear the partially cooked oil out of pipes, and re-starting the refinery can take several days or even weeks.

In advance of Isaac, refineries instead conducted what is known as an orderly shutdown, so they can re-start as soon as the power supply is assured again. The Gulf refineries will likely stay off line for about three days.

Isaac cut into the amount of gasoline being produced, and raised fears that supplies could fall dangerously low if the storm proved worse than expected. When supplies drop or are threatened, wholesale prices rise. Then distributors and station owners have to pay more to fill up their station's tanks. They then raise their prices based on how much they paid for their current inventory, how much they think they will have to pay for their next shipment, and, how much their competitors are charging.

Prices spiked particularly high in the Midwest because Isaac forced Shell to close a pipeline that delivers crude from St. James, La. to refineries in the region.

Gasoline prices are particularly vulnerable to spikes around this time of year. Refiners keep a low supply of more expensive blends as driving season ends, knowing they'll soon be able to make cheaper winter blends of gasoline.

"We are really working with a just-in-time delivery system," said Tom Kloza, chief oil analyst at the Oil Price Information Service.

Pump prices were on the rise even before Isaac blew in. The average price for gas rose about 40 cents from July 1 to mid-August because of higher oil prices and refinery problems in the Midwest and West Coast. At $3.80 per gallon, the national average is the highest since May 1 and well above the previous record for Aug. 29, $3.67 in 2008.

Wednesday's jump of a nickel was the 10th biggest one-day jump on record, according to OPIS, and the biggest since the average price rose 6 cents on February 15, 2011 when turmoil in Libya was rising.

But prices could quickly come down if refineries can soon get up and running. Crude oil prices fell Wednesday and wholesale gasoline prices fell the past two days, suggesting the spike in retail gasoline prices could be short-lived. Americans will soon do less driving and the switch to cheaper blends will be well underway by mid-September.

That's still too late for Sharon Simon of Gadsden, Ala. She's driving 900 miles north to her daughter's wedding in Olean, N.Y. this weekend, and will now have to spend an extra $30 to $50 on gasoline for the trip. "Just as we are getting ready to head out the prices go up," she said. "I'm fed up with the surge in price every time there is a holiday."

To strengthen your risk culture, start by asking these questions

As board members and management look to improve their organization's Enterprise Risk Management (ERM) system, it's important to start by asking several critical questions, financial consultant Roberta Wagner of Bugbee Wagner PLLC says. In this guest column, Wagner proposes several topics executive leaders should probe in order to strengthen the process. ?

Enterprise Risk Management: Organization or Culture Risk

The hub of any strong Enterprise Risk Management (ERM) system is the organization?s risk climate or culture, i.e., the attitude and approach the organization takes toward identifying, monitoring, controlling, and mitigating risk.

Truly understanding the risk climate requires more than just completing checklists. It is at the very heart of how executive management and the board approach risk and it?s often not black or white. How are decisions made in the organization? Are opposing concerns minimized? Are executives encouraged to discuss concerns? How does the board or executive management discuss the things that keep them awake at night? How strong is the ?bad-news network?? How is the quality of management and human resources practices incorporated into the ERM system?

Below are some questions that board members and CEOs might ask to begin this critical part of developing a sound ERM. We find in our work with organizations that assembling confidential board and management responses to these questions is often enlightening and can help to strengthen the risk culture.

1. Have the major perceived risks to the organization been:

a. Identified,

b. Ranked, and

c. Discussed with the board?

2. What risks do you see that are not either clearly identified or a part of management/board focus?

3. Has the board approved a risk appetite statement?

4. What are the incentives and penalties for officers who identify risk in the organization?

5. How are the ?cons? of a major new initiative handled in executive management and board sessions? Does an atmosphere of ?group think? prevail, or are alternative ideas encouraged?

6. What happens when a major risk is uncovered that was not identified by management?

7. How are concerns about executive performance handled?

8. Is the board conversant with the various risks?

9. Is there a split on the board?

10. Does the board add value to strategy development?

11. Can you clearly describe your institution?s strategy?

12. Does the entire executive management team have responsibility for ERM or has one lower level officer been assigned the responsibility?

13. Have both performance and leading indicators been identified for all major risks? (For example, on asset quality, a key performance indicator is the coverage ratio. Risk indicators for various concentrations in the portfolio might include industry performance ratios.)

14. How are risks monitored and reported? Do you have a risk model?

15. How strong are your controls on risk? (For example, audit or policy limits and reporting.)

Just answering these questions and having a candid, thorough discussion of what that means for ERM in your organization will take you a long way in developing a strong ERM system.

Confession: I hate public speaking.

The few readings I?ve done have been preceded by me telling my husband that fiction writers shouldn?t be expected to talk in front of other people, and that public speaking is a bizarre form of hazing. Nothing bad has happened?usually things go well?but they still make me nervous.

For the next one, I?m definitely going to reread Cynthia Leitich Smith?s post about how to handle public speaking events and potential problems like hecklers, not having enough time, and small turnout. Lots of really helpful advice and great anecdotes. I especially like her suggestion for how to politely respond to awkward or obnoxious questions.

Also, something very important to keep in mind about all kinds of author events:

?Say thank you, no matter what. The vast majority of children?s-YA book event planners are volunteers and among the most formidable champions of your field.?

Public speaking can be overwhelming, but it?s really helpful to keep in mind that the people planning and attending the events love these books. They?re not out to get you or make you feel awkward. They want to listen to you speak because you make something they love. And then you get to talk to them, too, and engage with them about their own reading and writing experiences. How cool is that?

BEIRUT (AP) ? Abu Qais, a Sunni Muslim in Syria's capital Damascus, says six members of his extended family have been killed by gunmen who belong to the minority Alawite sect of President Bashar Assad.

The gunmen who grabbed one of his distant cousins called up his family while they were torturing him "so they could hear his screams," said Abu Qais, an anti-Assad activist who spoke on condition his full name not be used for fear of reprisals.

Sectarian slayings between Syria's Sunni majority and the Alawite minority have been a brutal reality of Syria's 17-month-old conflict, and they have only accelerated as the country falls into outright civil war. Sunnis have largely backed the uprising against Assad's rule, while the Alawites ? members of an offshoot of Shiism ? have firmly stood behind the regime, where they fill the leadership ranks.

And as tit-for-tat killings have swelled, so has the segregation of the two communities as they flee each other. In Damascus and other cities, Sunnis and Alawites avoid venturing into each other's neighborhoods for fear of being snatched. Some Alawite districts in the capital are now ringed with checkpoints manned not only by security forces but also residents who have taken up arms to protect their homes.

Those in mixed neighborhoods flee their homes to move into safer enclaves dominated by their community ? whether in the same city or in another part of the country.

"Mutual threats in Damascus have succeeded in triggering migration," said Fateh Jamous, an Alawite activist from Latakia, the Mediterranean coastal city where many Alawites have fled. Latakia itself has so far represented a sort of tense neutral ground ? its population is about half Sunni, half Alawite. "That created a sort of balance of terror. So far, it has been generally peaceful," he said by telephone from Latakia.

The flight raises the grim possibility that Syria could go down the path of neighboring Iraq. There, violence in 2006 and 2007 effectively turned into a sort of sectarian cleansing, as Shiite and Sunni militias and insurgents targeted members of the rival community, killing thousands and sending hundreds of thousands fleeing their homes. To this day, Baghdad remains largely divided between wholly Shiite and wholly Sunni districts with few mixed areas remaining.

Syria has not yet reached that scale. But the prospect of it breaking up along religious or ethnic lines is no longer a remote possibility in a conflict that activists estimate has killed 20,000 people as Assad's regime tries to crush rebels determined to topple him. Kurds in the northeast have begun rumbling with talk of self-rule. Alawites have been pulling back into their ancestral heartland, along the Mediterranean coast and in the nearby mountains.

Some anti-regime activists believe that two reported massacres of Sunnis earlier this year, in the towns of Houla in May and Qubeir in June, aimed to drive Sunnis out of areas near main routes to the coast to ensure control of the Alawite enclave.

But the tearing apart of the two communities has been taking place on a smaller but increasing scale, neighborhood by neighborhood and city by city.

Their coexistence has always been uneasy. Sunnis make up the vast majority of Syria's 23 million people, and Alawites about 15 percent of the population. For the past 40 years, the Assad family's regime has enforced a secular ideology that zealously marketed the notion of equality among the nation's many religious and ethnic groups.

But at the same time, it was promoting the Alawite community to which the Assad family belongs.

Alawites, who had traditionally been among the poorest in Syria, were brought in by the Assads to fill the regime's leadership, elevating them into an elite class that had historically been Sunni. Top positions in the army, police and security agencies were given to Alawite men, while their women typically worked in the government. Significantly, inter-marriages between Sunnis and Alawites have been rare, though Assad himself is married to a British-raised Sunni who hails from the central city of Homs.

In Damascus' mostly Sunni neighborhood of Mazzeh, a resident named Moaz nostalgically remembers the woods that once stood on a hill close to his home. Then, years ago, the trees were cut down, and apartment blocs went up to house Alawites taking positions in the military and government. Their area, built within the Mazzeh area to promote an image of integration, became known as Mazzeh-86.

"Our relation with them was like a cold peace, 'We mind our own business and you mind yours'," recalled Moaz, a 28-year-old anti-Assad activist. He spoke on condition his full name not be used to protect himself and his family from reprisals.

Now the two areas are virtually at war. Alawites from Mazzeh-86 frequently help put down protests by Sunnis in the larger district, beating up protesters outside mosques alongside security forces. Checkpoints divide the two areas. In Sunni Mazzeh, there have been numerous slayings of those believed to be informers for the government, both Alawites and Sunnis, said Moaz.

"People with coastal accents (Alawites) are instantly recognized. They are arrogant and sure of themselves," he said.

Damascus had been largely unaffected by the fighting raging elsewhere in the country, until last month when rebels staged a major offensive in the city of 1.7 million people, sparking a heavy regime counter-attack. As the fighting raged, sectarian violence increased. So far, it has been concentrated in poor or lower middle-class neighborhoods of the capital, while most upscale districts remain peaceful, residents and activists say.

Alawites, who by some estimates make up 30 percent of Damascus' residents, have fled neighborhoods where they make up a small minority, finding relative security elsewhere where Alawite numbers are higher, residents and activists say. Many Alawite men send their families to their home villages near the coast.

"Most Alawites are in this with the view that it is a life or death war for them," said another Damascus resident by Skype. Identifying himself only as a "native Syrian" ? refusing to give his sectarian allegiance ? he said checkpoints outside Alawite neighborhoods have been beefed up in recent weeks, with up to 15 or 20 heavily armed security men and residents staffing them.

"The Alawites think that they would be subjected to genocide if Assad goes," he said.

Sectarian violence has been rampant in Homs, a major center of the revolt that was subjected to a devastating government siege earlier this year. Residents and activists say its population has been effectively divided into two sections, with Sunnis in one side and Alawites and Christians in the other.

Mohammed Saleh, a Homs resident and a rare Alawite who actively works with the opposition, says several months ago two Sunni men showed up at his apartment and ordered him to pack up and leave in 10 days.

"I made calls. I spoke to many of my friends and contacts in Homs and elsewhere. I was able to stay," Saleh, reached by telephone in Homs, said. But Saleh's son, who had been living with him, left with his wife and kids to an Alawite part of the city.

"I am never leaving," said Saleh, a trained chemist now making a living selling solar energy systems for household use, in huge demand because of lengthy power cuts. His work takes him across the entire city, but he never travels alone. "I make a point of taking with me someone from the neighborhood I am going to. Even if it is an Alawite district, I still go with a resident from there."

Some of Saleh's closest friends and neighbors have not been so lucky.

"In December and January alone, I lost a friend who was a Sunni doctor, another who was a Shiite engineer and a third one who was an Alawite army officer," said Saleh.

The price of oil rose to near $97 a barrel on Monday as Tropical Storm Isaac barreled across the Gulf of Mexico and toward the U.S. mainland, picking up strength and threatening oil and refining operations. An explosion at a refinery in Venezuela also pushed prices higher.

By early afternoon in Europe, benchmark crude for October delivery was up 79 cents to $96.94 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell 12 cents to finish at $96.15 per barrel on the Nymex on Friday.

In London, Brent crude rose 54 cents to $114.13 on the ICE Futures exchange.

Oil analyst Stephen Schork said in an email commentary that he expects "much higher volatility this week" due to Tropical Storm Isaac, which weather forecasters said would pick up strength before striking as a Category 2 hurricane somewhere between New Orleans and the Florida Panhandle on Wednesday.

Schork worries that the storm will be a repeat of Hurricanes Katrina in 2005 and Gustav in 2008, damaging Gulf refineries and pipelines and disrupting oil tanker traffic.

As of Sunday, work had been suspended on rigs accounting for 24 percent of daily oil production in the U.S. portion of the Gulf and eight percent of daily natural gas production there, the federal Bureau of Safety and Environmental Enforcement said.

Another factor pushing up prices was an explosion and fire that shut down operations at the Amuay refinery in western Venezuela, said Victor Shum, energy analyst at consultancy Purvin & Gertz in Singapore.

Amuay is among the world's largest refineries and is part of the Paraguana Refinery Complex, which also includes the adjacent Cardon refinery. Together, the refineries process about 900,000 barrels of crude per day and 200,000 barrels of gasoline.

In other Nymex trading, gasoline futures advanced 7.77 cents to $2.9882 per gallon, while heating oil rose 4.04 cents to $3.1591 per gallon. Natural gas rose 5.2 cents to $2.754 per 1,000 cubic feet.

Will Cook For Smiles: Beware Of The Volcano! Family Fun Night ...

So, many of you don't know that I am a new stay-at-home mom/grad student. I am still adjusting to not working, it's only been two weeks. I do find a lot of perks of being at home, like spending time with my family, always having time for house work, always having time for blog work and school work.


Speaking of school work, the classes started this week and the workload is unreal! They do expect a lot from a grad student and I am rusty! It's been over 4 years since I got my BA and I have not been to school since. I'm glad that I have all this time to work on my classes.

I really do like that I have all this time to spend with my husband. When I was working, we didn't send the little man to day care. Instead, we worked completely separate hours so we never, ever saw each other. It's been really good for our family for me to be home.

I also like to do family dinners now and family game and movie nights. To some, it may seem like a nothing new but we never had a family dinner unless it was a holiday. Like I said, we worked separate hours. So, a few days ago, I got us a new game to play on Wii. We all LOVE Wii, it's just so much fun! I also made the boys a fun dinner...

I made a Fries and Nuggets VOLCANO! Yes, a volcano and it came with a story! It...was..awesome!

There was a small, crispy island of OreIda that had the Mt. CrinkleCut on it (Hubby came up with the names) It was a peaceful and quiet home for the Nugget Dinasours, aka the Tysonsaurus. Where they lived their nice lives...


They were not aware that the Mt. CrinkleCut was actually a volcano! One day, they felt the rumble from below. They got scared and started running...


The Mt. CrinkleCut volcano started spewing hot, red lava! There went the island of OreIda!


After we had our fun with dinner, we went to play some Wii.



We just got a new Hasbro Family Game Night game to try. We got the first one, I'm thinking we will get the others too!? It had Battleship (my favorite), Sliders, Yahtzee, Connect Four and Boggle. Classic board games on Wii = fun!
